Terms of Sales


These General Conditions of Sale (GCS) govern sales made on the ORMAIN.COM website, an online sales platform for second-hand luxury products.

By accessing and using the Site, you fully and unconditionally accept these terms. If you do not agree with any of the provisions, please do not use our Site.

Our online store is aimed exclusively at consumers.

A “consumer” is defined as “any natural person who acts for purposes which are outside his trade, business, craft, profession or agricultural activity”.
A “professional” is defined as “any natural or legal person, public or private, who acts for purposes within the scope of his commercial, industrial, craft, liberal or agricultural activity, including when he acts in the name or on behalf of another professional”.

2. Purpose of the General Conditions of Sale


The purpose of these conditions is to define the terms and conditions of sale of the products offered on the ORMAIN.COM site, as well as the respective rights and obligations of the seller and the buyer.


3. Products


ORMAIN offers exclusively pre-owned luxury goods for sale, such as handbags, clothing, accessories, and other fashion items. ORMAIN is neither a partner nor affiliated with any of the brands featured on the site. Each product is carefully checked and authenticated before being put on sale.


3.1 Product descriptions and photographs
Product descriptions and photographs are provided for informational purposes only and are not contractually binding. ORMAIN cannot be held responsible for any errors in description, visual differences, or color variations due to lighting settings, contrast, or the technical characteristics of the buyer's screen.


3.2 Condition of the products
Each product is assigned a specific status, according to the following quality scale:

  • Never worn : The item has never been worn and has no defects.
  • Excellent condition : The item has been worn but has no visible defects. In the case of a pair of shoes, the sole may show slight signs of wear due to trying on.
  • Very good condition : The item has been worn, its overall condition is excellent, but it may have very slight defects, which will be specifically mentioned in the product sheet.
  • Good condition : The item has some visible signs of wear or defects, which will be specifically mentioned in the product sheet.
  • Correct : The item shows pronounced and visible signs of wear, which will be specifically mentioned in the product sheet.


4. Orders


4.1 Order process

Any order placed on the ORMAIN.COM website must be validated by the buyer after completing an online form, selecting the products, and proceeding to payment. Once the order is validated, a confirmation email will be sent to the buyer.


4.2 Availability of products

Products are offered while stocks last. If a product is unavailable after an order has been placed, ORMAIN undertakes to inform the buyer as soon as possible and to issue a refund.


4.3 Order modification

Orders can only be modified or canceled before shipment. Once an order has been shipped, it cannot be modified or canceled.


5. Price


5.1 Price of products

Product prices are listed in euros (€) and include all applicable taxes. ORMAIN reserves the right to change its prices at any time, but products will be invoiced at the price in effect at the time the order is validated.


5.2 Delivery costs

Shipping costs will be calculated based on the buyer's address and added to the order total before payment. ORMAIN offers several shipping methods, the rates of which may vary depending on the destination.


6. Payment


6.1 Payment terms

The following payment methods are available on our website:

  • Credit card payment (Shopify Payments): Credit card payments are handled by Shopify. Your card details (number, expiration date, and cryptogram) are entered on a highly secure page. ORMAIN does not store any banking information.
  • Payment in installments (Alma): Payment in installments/deferred payments is available through our partner Alma. All payments are protected by 3D Secure technology.

P2X: Purchases between €50 and €4,000
P3X: Purchases between €50 and €4,000
P4X: Purchases between €50 and €4,000


Transaction fees:
P2X: 3.92% per transaction
P3X: 4.18% per transaction
P4X: 4.85% per transaction


Alma is a telepayment manager and issues an electronic certificate which constitutes proof of the amount and date of the transaction in accordance with articles 1316 et seq. of the Civil Code.

The credit is granted by the company Alma, a company with a capital of €316,226.83, RCS Nanterre 839 100 757, ACPR approved under No. 90789 - Contact: support@getalma.eu . ORMAIN is a credit indicator in accordance with the provisions of R.519-2, 1° of the Monetary and Financial Code. The company ORMAIN distributes the advertisements sent by Alma relating to the granting of credit by Alma.

Alma's credit service is offered for the settlement of purchases and execution of payment, provided that the person purchasing the good or service through Alma (" Buyer ") accepts the contract for payment in installments or deferred payment.

Fees may be charged by Alma.

Any refusal to grant payment in installments or deferred payment by Alma may result in the lapse of the contract for the purchase of the goods or services (“ GTC ”), unless the Buyer agrees to pay the purchase amount in cash.

In the event of termination of the General Terms and Conditions, the contract for payment in installments or deferred payment will be terminated automatically.

In the event of withdrawal from the payment solution in several installments or deferred payment used for your payment, the General Terms and Conditions will be terminated automatically, unless you pay the amount of your purchase in cash through Alma. If the product has already been shipped to you, you must return it within the maximum period provided for in these General Terms and Conditions.

The amount is partly paid by a credit granted by Alma SAS, payment institution and financing company approved by the ACPR under n° 17408 - CIB code.

In accordance with Article L.312-50 of the Consumer Code, in the event of payment in installments, including the payment of a deposit, the buyer is provided with a receipt on paper or any other durable medium serving as a receipt and containing a full reproduction of the provisions below (Articles L. 312-52, L. 312-53 and L. 341-10 of the Consumer Code):

Article L312-52: The contract of sale or provision of services is terminated automatically, without compensation:

1° If the lender has not, within seven days of acceptance of the credit agreement by the borrower, informed the seller of the granting of the credit;

2° Or if the borrower has exercised his right of withdrawal within the period provided for in Article L. 312-19.

However, when the borrower, by express request, requests the immediate delivery or supply of the goods or the provision of services, the exercise of the right of withdrawal from the credit contract shall not automatically terminate the contract of sale or provision of services unless it occurs within three days of the borrower's acceptance of the credit contract. The contract shall not be terminated if, before the expiry of the periods mentioned in this article, the purchaser pays in cash.

Article L312-53: In the event of termination of the sales contract or the provision of services provided for in Article L. 312-52, the seller or service provider shall reimburse, upon simple request, any sum that the buyer may have paid in advance of the price.

Article L341-10: In the event of termination of the sales contract or the provision of services provided for in Article L. 312-53, from the eighth day following the request for reimbursement of any sum paid in advance by the buyer, this sum shall automatically bear interest at the legal interest rate increased by half.

  • Pay via PayPal: You can also choose to pay via PayPal, which offers a secure online payment solution. Payment will be charged directly to your PayPal account or to the card linked to that account.
  • PayPal installment payment: PayPal also offers the option to pay for your purchases in installments (depending on eligibility and PayPal's terms and conditions). This option allows you to pay in 3 or 4 installments, depending on the order amount and PayPal's specific terms and conditions.

  • Pay with Apple Pay: If you have a compatible Apple device, you can use Apple Pay to pay securely without having to enter your banking information every time you make a purchase.

6.2 Payment security
All transactions on ORMAIN are secure. When paying by credit card, payment information is transmitted encrypted to our payment service provider.


7. Delivery


7.1 Delivery times

The preparation and processing time for your order is 24 hours during our logistics department's business days, from Tuesday to Saturday (excluding exceptional closing days). The delivery times communicated are understood to be after shipment.


The following delivery methods are offered, exclusively via Chronopost:
Delivery to a collection point: Next-day delivery before 1 p.m. (excluding weekends and public holidays). Free for all orders over €500.00. (excluding European collection points)

Delivery to a European relay point: Delivery within 2 to 5 working days (excluding weekends and public holidays).


Express home delivery: Next day delivery before 1 p.m. (excluding weekends and public holidays).


Express Home Delivery (Saturday): Saturday delivery only, for orders placed before Friday 11:00 a.m.


Pick up at the showroom: Pick up at the showroom located at 14 Rue Saint-Antoine du T, 31000 Toulouse, during opening hours.


7.2 Delivery costs
Delivery costs are the responsibility of the buyer and will be indicated before the order is confirmed.


7.3 Delay in delivery
In the event of a delivery delay, ORMAIN undertakes to inform the buyer as soon as possible and to provide them with a tracking link to follow the progress of their delivery. Delays due to external events (strikes, exceptional weather conditions, impossibility of collection, etc.) cannot be attributed to ORMAIN .


7.4 Export costs
Any additional customs clearance fees (taxes and other) are the buyer's responsibility and must be paid upon delivery, depending on the destination country. An estimate of customs fees can be provided before ordering. No refunds for import fees will be issued.


7.5 Damage occurring during transport
In the event of apparent damage upon delivery, the buyer must express reservations or refuse delivery to the delivery person and send the reasons for refusal by letter to the carrier and contact us as soon as possible.


8. Right of withdrawal and returns


8.1 Right of withdrawal
In accordance with current legal provisions, the buyer has a 14-day right of withdrawal from the date of receipt of the order, to return the product without giving a reason. Return requests must be made by email to contact@ormain.com or via the online customer area.


8.2 Return conditions
The product must be returned in its original, unworn condition, in its original packaging, with all accessories, tags, and certificates of authenticity. The product must be accompanied by its tag and seal; their removal will result in the return being refused. Return shipping costs are the responsibility of the buyer.


8.3 Reimbursement
Refunds will be issued within 14 days of receipt of the returned product, subject to compliance with the return conditions. Refunds will be issued to the original payment method, unless otherwise agreed (excluding gift cards or credit notes).


8.4 Purchase at a physical point of sale
Purchases made at one of ORMAIN 's physical points of sale are neither exchangeable nor refundable.


9. Warranties and Authentication of Products


9.1 Legal guarantees
ORMAIN complies with the legal guarantees of conformity provided for in Article L.217-7 of the Consumer Code, as well as the guarantee against hidden defects provided for in Article 1641 of the Civil Code.


9.2 Authentication
All products sold on the ORMAIN website are guaranteed authentic and pre-owned, after careful verification and authentication by our experts. An ORMAIN certificate of authenticity will be provided to the buyer upon purchase.


In order to strengthen the guarantee of authenticity of the products offered for sale, ORMAIN also offers the possibility of obtaining an Entrupy authentication certificate for certain items, for an additional fee of €90 per product (excluding Hermès products) and €190 for Hermès products.


The Entrupy certificate is an authentication document issued by an advanced digital verification system based on artificial intelligence and imaging technology. This certificate attests that the product has been authenticated using this technology, thus providing further proof of its authenticity.
If you would like to obtain an Entrupy authentication certificate for one of our products, we invite you to contact us directly, either before or after purchase, provided that the order has not yet been processed. The fee for this certificate will be added to your order or will be subject to a separate additional charge.


10. Liability


10.1 Buyer's liability
The buyer agrees to provide accurate information when ordering, including the delivery address. ORMAIN cannot be held responsible for data entry errors leading to incorrect delivery.


10.2 Responsibility of ORMAIN
ORMAIN is committed to providing a quality service, but cannot be held responsible in the event of force majeure or events beyond its control (strikes, disruptions to delivery services, etc.).


11. Intellectual Property


All content on the ORMAIN website (texts, images, logos, etc.) is protected by intellectual property rights. Any reproduction, representation, modification, or exploitation, partial or total, of the contents of the site is prohibited without the prior agreement of ORMAIN .


12. Protection of personal data


In accordance with the GDPR, ORMAIN collects and uses users' personal data for order processing and marketing purposes, unless the buyer has objected. This data is not shared with third parties unless necessary for order fulfillment.


13. Applicable Law and Dispute Resolution


These General Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. If no amicable solution is found, the dispute will be submitted to the competent courts.


In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, ORMAIN offers a consumer mediation system. The selected mediation entity is:

14. Modifications to the General Conditions of Sale


ORMAIN reserves the right to modify these General Terms and Conditions at any time. The applicable conditions will be those in effect at the time of the order.
