These General Terms and Conditions of Sale govern sales made on the ORMAIN.COM website, an online sales platform for second-hand luxury goods. By accessing and using the site, you fully and unreservedly accept these conditions. If you do not agree with any of the provisions, please do not use our site.
Our online store is aimed exclusively at consumers. A "consumer" is defined as "any natural person acting for purposes outside their trade, business, craft, profession, or agricultural activity." A "professional" is defined as "any natural or legal person, public or private, acting for purposes within their trade, business, craft, profession, or agricultural activity, including when acting in the name or on behalf of another professional."

2. Purpose of the General Conditions of Sale
These conditions define the terms and conditions of sale of the products offered on the ORMAIN.COM site, as well as the respective rights and obligations of the seller and the buyer.
3. Products
ORMAIN offers exclusively pre-owned luxury goods for sale, such as handbags, clothing, accessories, and other fashion items. ORMAIN is not a partner or affiliated with any of the brands featured on the site. Each product is carefully checked and authenticated before being put on sale.
3.1 Product descriptions and photographs
Descriptions and photographs are provided for informational purposes only and are not contractually binding. ORMAIN cannot be held responsible for any errors in description, visual differences or color variations due to lighting settings, contrast or the technical characteristics of the buyer's screen.
3.2 Condition of products
Each product is assigned a specific status, according to the following scale:
- Never worn : The item has never been worn and has no defects.
- Excellent condition : The item has been worn but has no visible defects. For a pair of shoes, the sole may have very slight traces of trying on.
- Very good condition : The item has been worn, the overall condition is excellent, but it may have very slight defects, mentioned in the product sheet.
- Good condition : The item has some signs of wear or visible defects, mentioned in the product sheet.
- Correct : The item shows pronounced and visible signs of wear, mentioned in the product sheet.
4. Orders
4.1 Order process
Any order placed on ORMAIN.COM must be validated by the buyer after completing an online form, selecting the products, and proceeding to payment. Once the order is validated, a confirmation email is sent.
4.2 Availability of products
Products are offered while stocks last. In the event of unavailability after ordering, ORMAIN will inform the buyer as soon as possible and issue a refund.
4.3 Order modification
Orders can only be modified or canceled before shipment. Once shipped, no modifications or cancellations are possible.
5. Price
5.1 Price of products
Prices are listed in euros (€) and include all applicable taxes. ORMAIN reserves the right to change its prices at any time; products are invoiced at the price in effect at the time the order is validated.
5.2 Delivery costs
Shipping costs are calculated based on the buyer's address and added before payment. Several shipping methods are available, with rates varying depending on the destination.
6. Payment
6.1 Payment terms
- Credit card (Shopify Payments) : Payment is processed by Shopify on a highly secure page. ORMAIN does not store any banking data.

Payment in installments (Alma) : Payment in installments/deferred via Alma. Payments are protected by 3D Secure.

Alma is a telepayment manager and issues an electronic certificate serving as proof of the amount and date of the transaction (articles 1316 et seq. of the Civil Code).
The credit is granted by Alma (capital €316,226.83, RCS Nanterre 839 100 757, ACPR approved no. 90789) – contact: support@getalma.eu . ORMAIN is a credit indicator within the meaning of article R.519-2, 1° of the Monetary and Financial Code. Help: help.almapay.com .
Alma's credit service is offered subject to the buyer's acceptance of the installment or deferred payment agreement. Fees may apply. Refusal may result in the purchase agreement being void, unless cash payment is accepted.
In the event of termination of the General Terms and Conditions, the payment contract in installments/deferred payments is automatically terminated. In the event of withdrawal from the payment solution, the General Terms and Conditions will be terminated unless payment is made in cash through Alma.
The amount can be partly paid by a credit granted by Alma SAS, payment institution and financing company approved by ACPR n° 17408 (CIB code).
Provisions of the Consumer Code
Article L.312-52 : The sales/service contract is automatically terminated, without compensation: 1° if the lender has not, within seven days of the borrower's acceptance of the credit contract, informed the seller of the granting of the credit; 2° if the borrower has exercised his right of withdrawal within the period provided for in Article L. 312-19. However, upon express request from the borrower for immediate delivery, automatic termination only applies if the withdrawal occurs within three days of acceptance of the credit. The contract is not terminated if the purchaser pays cash before the expiry of the deadlines.
Article L.312-53 : In the cases of termination provided for in Article L. 312-52, the seller reimburses, upon simple request, any sum paid in advance on the price.
Article L.341-10 : From the eighth day following the request for reimbursement of the sums paid in advance by the buyer, these sums automatically produce interest at the legal interest rate increased by half.
- PayPal : Secure payment via your PayPal account or linked card.
- PayPal in installments : possibility of paying in 3 or 4 installments depending on PayPal's eligibility conditions (see the PayPal website).
- Apple Pay : Available on compatible Apple devices, without repeated entry of banking information.
6.2 Payment security
All transactions on ORMAIN are secure. When paying by credit card, payment information is transmitted in encrypted form to our service provider.
7. Delivery
7.1 Delivery times
The preparation and processing time is 24 hours on logistics service opening days (Tuesday to Saturday, excluding exceptional closures). The times below are understood to be after dispatch and are provided exclusively via Chronopost:
- Relay Point (France) : Next day delivery before 1 p.m. (excluding weekends and public holidays). Free from €500.00 (excluding European relay points).
- Relay point (Europe) : 2 to 5 working days (excluding weekends and public holidays).
- Express home delivery : next day delivery before 1 p.m. (excluding weekends and public holidays).
- Express Home Delivery (Saturday) : Saturday delivery for orders placed before 11 a.m. on Friday.
- Showroom collection : 14 Rue Saint-Antoine du T, 31000 Toulouse, during opening hours.
7.2 Delivery costs
Delivery costs are the responsibility of the buyer and are indicated before the order is confirmed.
In the event of non-collection within the time limits set by the carrier (e.g. relay point) or non-receipt following a delivery failure/refusal, the package is returned to the sender. This situation is considered a breach of contract by the customer, without valid exercise of the right of withdrawal. The order is then considered cancelled; a partial refund is made, less:
- initial delivery charges;
- return costs charged by the carrier.
The amount reimbursed is communicated to the customer, with supporting documents upon request.
7.3 Delay in delivery
In the event of a delay, ORMAIN will inform the buyer as soon as possible and provide a tracking link. Delays due to external events (strikes, exceptional weather conditions, impossibility of collection, etc.) cannot be attributed to ORMAIN .
7.4 Export costs
Customs clearance fees (taxes, etc.) are the buyer's responsibility and are payable upon delivery depending on the destination country. An estimate can be provided before ordering. No refunds for import fees will be issued.
7.5 Damage during transport
In the event of apparent damage upon delivery, the buyer must express reservations or refuse delivery to the delivery person, send a reasoned letter to the carrier and contact us as soon as possible.
8. Right of withdrawal and returns
8.1 Right of withdrawal
In accordance with the law, the buyer has 14 days from receipt to return the product without giving a reason. Return requests can be made by email to contact@ormain.com or via the customer area.
8.2 Return conditions
The product must be returned in its original, unworn condition, in the original packaging, with all accessories, tags, and certificates of authenticity. The tag and seal must be present; their removal will result in the refusal of the return. Return shipping costs are the responsibility of the buyer.
8.3 Reimbursement
Refund within 14 days of receipt of the compliant product, on the initial payment method unless otherwise agreed (excluding gift card/credit).
8.4 Purchase at a physical point of sale
Purchases made at a physical ORMAIN point of sale are neither exchangeable nor refundable.
9. Product warranties and authentication
9.1 Legal guarantees
ORMAIN respects the legal guarantees of conformity (art. L.217-7 of the Consumer Code) and against hidden defects (art. 1641 of the Civil Code).
9.2 Authentication
All products sold are guaranteed authentic and pre-owned, after verification and authentication by our experts. An ORMAIN certificate of authenticity is provided upon purchase.
In addition, ORMAIN offers an Entrupy authentication certificate for certain items, for €90 per product (excluding Hermès) and €190 for Hermès products.
The Entrupy certificate is based on imaging and AI technology to attest to authenticity. It can be requested before or after purchase (if the order has not yet been processed). Fees are added to the order or billed separately.
10. Liability
10.1 Buyer's liability
The buyer agrees to provide accurate information, including the delivery address. ORMAIN is not responsible for data entry errors resulting in incorrect delivery.
10.2 ORMAIN's liability
ORMAIN is committed to providing a quality service, without being held responsible in the event of force majeure or events beyond its control (strikes, disruptions to delivery services, etc.).
11. Intellectual Property
All contents of the ORMAIN website (texts, images, logos, etc.) are protected by intellectual property rights. Any reproduction, representation, modification or exploitation, even partial, is prohibited without prior agreement from ORMAIN .
12. Protection of personal data
In accordance with the GDPR, ORMAIN collects and uses personal data for order processing and marketing purposes, unless the buyer objects. Data is not shared with third parties unless necessary to fulfill the order.
13. Applicable Law and Dispute Resolution
These General Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought. Failing this, the matter will be referred to the competent courts.
